Terms of Use

1) Purpose of the App

The RMIS Traceability App is designed to facilitate the exchange of livestock traceability data between Datamars devices and Datamars-approved backend systems, including RMIS. The App provides a technical mechanism for data capture, offline operation, and synchronization.

2) Eligibility and access

• You must be authorized by Datamars or an approved organization to use the App.
• Access credentials may not be shared or transferred.
• Datamars may suspend or revoke access at any time, without notice.

3) Acceptable use

You agree to use the App only for its intended operational and traceability purposes.

• Do not attempt to bypass security, authentication, or access controls.
• Do not upload false, misleading, unlawful, or unauthorized data.
• Do not interfere with device integrations or system integrity.

4) Data responsibility

You are solely responsible for the accuracy, completeness, and legality of all data captured, transmitted, or synchronized through the App.

Datamars provides the App as a technical tool only and does not verify, validate, or control the nature, content, or accuracy of data exchanged with RMIS or other systems.

Any agreement regarding the use, processing, or interpretation of data exists exclusively between you and RMIS or other third-party platforms.

5) Offline operation

The App supports offline data capture. You are responsible for ensuring that data is synchronized when connectivity is available. Datamars is not responsible for data loss, corruption, or delay caused by offline usage, device failure, or improper operation.

6) Intellectual property

The App, including its software, design, and content, is owned by or licensed to Datamars. You are granted a limited, non-exclusive, non-transferable right to use the App solely for approved purposes.

7) Availability and changes

The App may be updated, modified, suspended, or discontinued at any time. Features may change to reflect device updates, regulatory requirements, or operational needs.

8) Third-party systems

The App integrates with third-party systems, including RMIS, to enable data exchange. Datamars is not responsible for the availability, performance, accuracy, security, or reliability of any third-party systems.

9) Disclaimer

The App and Datamars devices are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

10) Limitation of liability

To the fullest extent permitted by law, Datamars shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, or reputation, arising from the use of the App, Datamars devices, or RMIS integrations.

11) POPIA compliance

By using the App, you acknowledge and consent to the collection, processing, and storage of personal information as required for livestock traceability and management.

You accept full responsibility for ensuring that any personal information shared through the App complies with the Protection of Personal Information Act (POPIA) and other applicable laws.

12) Governing law

These Terms are governed by the laws of the Republic of South Africa.
